II. Information We Collect
1. Personal Data: We collect information (whether online, by phone, or by paper) that enables the ACC to identify or contact you (“Personal Data”) to carry out our business purposes, including sending you information and updates for conference and webinar events, publications, and education and advocacy. ACC Sites collect this information when you apply or register for ACC events, or otherwise interact with the ACC, including, but not limited to, applying for membership, or registering for an ACC event or program. The types of Personal Data collected includes but is not limited to your name, address, phone number(s), birth date, billing and delivery information, email address, Internet Protocol addresses, credit card, or other financial account information.
III. How We Use and Share Your Personal Data
Once collected, we use your Personal Data in a variety of ways including, but not limited to:
• Provide service communications such as bill reminders, order confirmations, event and program
registrations, and customer service messages
• Respond to your emails or online requests for information
• Deliver and process surveys
• Personalize and improve the usability of the Sites
• Publish membership directories and registration lists as described below, and fulfill and delver
other ACC products and services
• Tailor content, advertising and marketing to you
Publication of your Personal Data for Membership Directories and Registration Lists. To allow industry members and others to find you, some Personal Data we receive may be published on the Sites and other print or digital media, in a variety of ways, including, but not limited to, directories, membership lists, and other types of registration lists for ACC events (“Directory Lists”). Directory Lists will not include sensitive information, such as credit card or bank information. Users may request their information be suppressed from Directory Lists by contacting us using the information in the “Contact Information” section below.
Sharing your Personal Data to Fulfill Service Requests and Perform Business Functions. When fulfilling service requests initiated by you, we may share your Personal Data with certain third parties to fulfill the requests. We may also share such information with service providers that perform business functions for us. For example, the ACC occasionally hires other companies to provide limited services on our behalf including, but not limited to, website and data hosting services, publications services (packaging, mailing, printing, sending postal mail or email) and program services (processing event, webinar, and other registrations). In such cases, the ACC may share your Personal Data. Additionally, information is collected by our building management and security company for individuals visiting our office (name, identification and business contact information) and camera supervision is used for reasons of security and safety of persons and belongings.
Sharing your Personal Data When Legally Necessary or to Protect the ACC’s Interests. The ACC may disclose your Personal Data if required to do so by law or in the good-faith belief that such action is necessary to: (a) conform to legal requirements or comply with legal process served on the ACC; (b) protect and defend the rights or property of ACC; (c) protect the personal safety of ACC personnel or members of the public in appropriate circumstances or (d) share data with third parties if the ACC and/or its assets are sold, assigned, transferred, or merged.
Sharing your email Address Pursuant to ACC Policy. Your email address will only be used by the ACC and its entities. The ACC may share email addresses with third parties as necessary for the ACC to perform certain services on our behalf, such as magazine advertisement, packaging, mailing and delivering products and processing event, webinar, and other registrations and to respond to your service requests. The ACC may also share your email address with third parties to enable the ACC to take security measures to help protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data. We do not sell or rent email addresses to anyone outside the ACC.
IV. How You Can Access, Change and Delete Your Personal Data
You can review, update and correct your information on ACC’s website www.americancoalcouncil.org using your ACC ID and password. If you need assistance logging in, please contact us at firstname.lastname@example.org. You can request, at any time, that we delete your Personal Data by contacting us using the information in the “Contact Information” section below.
You can change e-mail preferences, including “opting out” of email by contacting us using the information in the contact in the “Contact Information” section below.
V. How We Use and Share Non-Personal Data
Through the use of various technological tools, we collect Non-Personal Data to improve the usability of our Sites/Services and for other business reasons. We share the Non-Personal Data we collect with third parties or permit third parties to place tools like cookies, tags and web beacons, to collect additional Non-Personal Data when you browse our Sites. We or other third party companies may then use the Non-Personal Data to provide advertisements and targeted advertisements to you (ads based on the Non-Personal Data). We do not share Personal Data with third parties with whom we share your Non-Personal Data. Please note that you may be subject to the privacy policies of other non-ACC companies when you select an advertising link or other link that takes you to sites not operated by the ACC.
We do not knowingly collect Personal Data from or market to children under the age of 13.
VII. California Privacy Rights
FOR CALIFORNIA RESIDENTS ONLY. Section 1798.83 of the California Civil Code requires select businesses to disclose policies relating to the sharing of certain categories of your Personal Data with third parties. If you reside in California and have provided your Personal Data to ACC, you may request information about our disclosures of certain categories of Personal Data to third parties for direct marketing purposes. VIII. Canada Anti-Spam Law
FOR CANADIAN RESIDENTS ONLY. We comply with the Canada Anti-Spam Law. Users who provide us a Canadian mailing address will not receive unauthorized Commercial Electronic Messages (as defined under the Canada Anti-Spam Law) unless these individuals have “opted-in” to receive Commercial Electronic Messages.
IX. General Data Protection Regulation
FOR EUROPEAN RESIDENTS ONLY. If the processing of your personal information is subject to the EU General Data Protection Regulation (“GDPR”), and your personal information is processed based on legitimate interests, you have the right to object to the processing on grounds relating to your specific situation. Under GDPR you may also have the right to request to have your personal information deleted or restricted and ask for portability of your personal information. X. Transfer of Personal Date Outside of the European Economic Area and International Users
We are headquartered in the United States. Your Personal Data may be accessed by us or transferred to us in the United States or to our affiliates, partners, merchants, or service providers who are located worldwide. If you are visiting our Site from outside the United States, be aware that your information may be transferred to, stored, and processed in the United States where our servers are located, and our central database is operated. By using our Service, you consent to any transfer of this information.
XI. Information Security
Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. Accordingly, and despite our efforts, the ACC cannot guarantee or warrant the security of any information you transmit to us, or to or from our online products or services.
